SYNOPSIS

     Directs professional and occupational boards to promulgate rules for licensee use of generative artificial intelligence.

An Act concerning generative artificial intelligence use in regulated professions and occupations and supplementing Title 45 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Within 1[three] six1 months after the date of enactment of this act, and notwithstanding the provisions of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) to the contrary, the Director of the Division of Consumer Affairs shall, immediately upon filing proper notice with the Office of Administrative Law, adopt rules and regulations establishing a model policy for the use of generative artificial intelligence by a licensee in the practice of a profession or occupation regulated by each professional or occupation board designated in section 2 of P.L.1978, c.73 (C.45:1-15).

     b.    Within 1[six] nine1 months or at the next regularly scheduled meeting of a professional or occupational board following the establishment by the director of the model policy required pursuant to subsection a. of this section, each professional or occupational board shall, notwithstanding the provisions of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) to the contrary, promulgate rules and regulations adopting the model policy with any profession or occupation-specific adaptations deemed necessary by the professional or occupational board.

     c.     The rules and regulations adopted pursuant to subsections a. and b. of this section shall be in effect for a period not to exceed one year after the date of the filing.  These rules and regulations shall thereafter be adopted, amended, or readopted by the Director of the Division of Consumer Affairs and each professional and occupational board in accordance with the requirements of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).

     d.    As used in this section, "generative artificial intelligence" means a technology system that:  (1) is trained on data; (2) is designed to simulate human communication through one or more of the following: (a) text; (b) audio; or (c) visual communication; and (3) generates non-scripted outputs with limited or no human oversight.

 

     2.    This act shall take effect immediately.
